Hundred and Forty-second Report on the petition praying for grant   of one rank one pension to the armed forces personnel.
The Committee on Petitions of Rajya Sabha under the Chairmanship of Shri Bhagat Singh Koshyari, MP, presented its Hundred and Forty-second Report to the Rajya Sabha on 19th December, 2011 on the petition praying for grant of one rank one pension to the armed forces personnel.  
2. The Petition was submitted by Shri Sanjay Prabhu and others, resident of Bangalore and countersigned by Rajeev Chandrasekhar, MP, Rajya Sabha.
3. The Committee during the course of its deliberations  interacted with the petitioners, representatives of Departments of Ex-servicemen Welfare (M/o Defence), Expenditure (M/o Finance) and Pensions and Pensioner's Welfare (M/o Personnel, Public Grievances and Pensions) and some organizations/individuals.    
4. Following are the important recommendations of the Committee:-
4.1  The Committee has taken note of the fact that  a sum of Rs.1300 crores is the total financial liability for the year 2011-12 in case OROP is implemented fully for all the defence personnel in the country across the board.  The Committee was informed that out of this,  1065 crores would go to retirees belonging to Post Below Officer Ranks (PBOR) while the Commissioned Officers would be getting the remaining i.e.  235 crores.  The Committee felt that  1300 crores is not a very big amount for a country of our size and economy for meeting the long pending demand of the armed forces of the country.  The Committee understand that this  1300 crores is the expenditure for one year which might increase at the rate of 10 percent annually.  Even if it is so, the Committee does not consider this amount to be high, keeping in view the objective for which it would be spent.

4.2  The Committee was not convinced with the version of the Ministry of Finance that the grant of OROP to the defence personnel would eventually  generate similar requests from the civilian work force of the country under the Central Government and the State Governments.  The Committee feels so because of the quite different terms and conditions of service of the two different categories of employments.  The terms and conditions of armed forces are tougher and harsher than the civilian Government employee.  On the issue of returning of service medals by the defence personnel of our country to the President of India in view of the Governments' apathetic attitude towards their demand of grant of OROP,  the Committee was of the view that our defence personnel should not feel alienated to this extent again and they are not forced to surrender their hard earned service medals in this manner to exhibit their discontent with the government policies.

4.3  The Committee also felt that the decision of the Government to bring our defence personnel on the pattern of the civilians with regard to their pay, pension, etc. (from Third Central Pay Commission onwards) is not a considered decision which has  caused hardship to the defence personnel and has given birth to their demand for OROP.  The Committee understand that before the Third Central Pay Commission, the defence personnel were getting their pay / pension on the basis of separate criteria unconnected with the criteria devised for the civilian work force. That criteria acknowledged and covered the concept of OROP which has been given up after the Third Central Pay Commission.

The approximate arrear amount calculation has been made for the loss of one increment in pre-revised scale, for those date of increment falls between Feb-Jun. The table express the total amount of arrear from 1.1.2006 according to the increment amount.
This is the general calculation for all Central Government employees, not included the Overtime, Incentive and other benefits.

Hospital buries its ‘ rat- nibbled’ shame on campus

FOR A man who had donated his body for the welfare of the medical professionals, it was an end most unceremonious. Professor Rameshwar Sharma, late principal of the Jaipur Sawai Man Singh ( SMS) medical college, had willed that after his death his body should be donated to the college.
But the ignorant college authorities failed to appreciate his generous gesture.
After rats started nibbling the body — kept in the anatomy department of the medical college — it was declared not fit for use and buried in the college campus on Thursday.
MAIL TODAY had reported in July 2011 how parts of Sharma’s body were damaged by rats, including the left toe which had been completely eaten away by the rodents.
Details emerging now reveal how the anatomy department callously failed to take care of the body despite tall claims.
The body degenerated to the point that it was rendered unfit for the students.
Principal of the SMS medical college, Dr Subhash Nepalia, said the body had degenerated, and the decision to bury it was taken after a written consent from Sharma’s family.
He said the skeleton would be exhumed for benefit of the students.
Anatomy department head, Dr G. C. Agrawal — in whose presence the body was buried — refused to take any questions, saying he was under instruction from the principal not to discuss the matter.
“ You should talk to the principal only,” he said.
Dr Pradeep Sharma, son of the late principal, said he was aware of the matter. “ He ( Rameshwar Sharma) often used to say that whatever he was, it was because of the SMS medical college and, therefore, wanted to do something for the institution.
When he was the principal, he had expressed the desire to donate his body to the college to tackle the shortage of cadavers,” Pradeep, a psychiatrist at Jaipur’s Psychiatric Centre, said.
Dr Sharma died on January 4, 2007, and his family donated the body immediately to the college.
The anatomy department embalmed the body and left it on a stretcher in the college morgue. But when the sorry state of affairs was revealed in July, Agarwal had said he did not know whose body it was. He claimed the body was to be handed over to the privately run Mahatma Gandhi Medical College in Jaipur. A senior anatomy professor, Dr Sangeeta Chouhan, identified the body.
SMS medical college requires over 20 human cadavers every year. Excess corpses were offered to other medical colleges.
A winner of the B. C. Roy award for his contribution to medical education, Dr Sharma was also the vicechancellor of Rajasthan University.
He was the founder of the Indian Institute of Health Management Research.

1          An advertisement from the Congress Party of India has appeared in to-day’s news papers. This concerns the issues relating to ex-servicemen and Defence matters. This is appreciated. Attention of all the political parties engaged in the current elections is drawn to the monumental neglect of less mortals who are serving the Armed forces of the Union of India. They are Defence Services Civilians who are paid salaries and pensions from Defence Services Estimates. Defence Services Civilian Pensioners are authorized for CSD Canteen Facility and the Status of Ex-servicemen as per laid down Army order and definition of ex-servicemen. Despite their contribution to the Armed Forces both in peace and war and despite their authorization they have been denied these facilities and status. The contestants of the current elections are requjested to take up these issues in their agenda.

2.         Central government Health Scheme was launched in the year 1954 for all Central Government Employees and Pensioners. In these 58 years this scheme has so far only covered 24 cities. Whole of Punjab state is uncovered by this scheme till now. Employees can avail medical facilities under CS (Medical Attendance Rules 1944 but there is no medical cover for the Pensioners. The stand condemned. On 27 Jan 2011 Director General Health Services Ministry of Health had stated a move to expand the scheme to Jalandhar (Punjab). But the effort has died even before it was properly taken up. We urge the contestants from Punjab in the current elections to take up this issue as agenda. Our memoranda to the Members of Parliament so far have brought no relief.

Procedures to streamline Medical Reimbursement claims under CGHS

In the normal circumstances, the pensioner who is CGHS beneficiary and his/her dependent family members are entitled to get cashless medical treatment In CGHS empanelled private hospitals on a referral by a Government medical specialist / CMO in-charge, after obtaining prior permission from the CMO in-charge of the CGHS Wellness Centre/Dispensary they are attached to.
In certain situations, the pensioner and his/her dependents are also entitled for reimbursement of medical expenses incurred by themselves or any of their dependent family members.  In such cases, the pensioner has to file Medical Reimbursement Claims (MRCs) with the respective CGHS Wellness Centres they are attached to.
The CMO in charge of the concerned wellness centres, will examine the said claims with reference to the checklist perscribed to them and forward the claims to the Office of the AD/JD in charge of the Zone/City.  Thereafter, the concerned office of AD/JD will process the claim and do the needful to reimburse the admissible amount to the pensioner.
Based on the complaints received in this regard, the department of Health and family welfare has issued the followingcircular (F. No. S.11024/8/2011/CGHS(P) dated 14.11.2011).

SUBJECT : Streamlining of Procedure for disposal of Medical Reimbursement Claims (MRCs) in CGHS
The pensioner CGHS beneficiaries and their dependent family members are entitled to get cashless medical treatment In CGHS empanelled private hospitals on a referral by a Government medical specialist / CMO in-charge, after obtaining prior permission from the CMO in-charge of the CGHS Wellness Centre/Dispensary they are attached to.
They are however, also entitled to obtain the medical services from any un-empanelled hospital in emergency condition and get reimbursement of medical expenses incurred by themselves or any of their dependent family members.
They can file Medical Reimbursement Claims (MRCs) with the respective CGHS Wellness Centres they are attached to- The CMO In charge is expected to scrutinize the claim papers with reference to the prescribed Checklist and forward the same to the Office of AD/ JD in charge of the zone/city. The Office of AD/JD processes the claim and arranges reimbursement of the admissible amount to the pensioner beneficiary at the earliest.
2. A number of complaints are being received from the pensioner beneficiaries about the slow and tardy pace of disposal of MRC claims by CGHS, Complaints have also been received about the unnecessary harassment of pensioner beneficiaries who are also senior citizens, affecting them mentally and financially, and thereby creating a bad image for CGHS. CGHS is responsible for taking care of healthcare needs and well being of the central government employees and pensioners. It has therefore been decided to lay down a comprehensive procedure to be followed by all concerned in CGHS to ensure timely and hassle free disposal of the MRC claims by CGHS in order to facilitate prompt reimbursement of medical expenses to the pensioner beneficiaries.
3. The procedure to be followed by CGHS for dealing with MRC cases shall be as follows;
i. The beneficiary will submit the MRC in the prescribed format with all relevant supporting vouchers/documents in original, to the CMO-I/C of the relevant CGHS Wellness Centre. The CGHS Wellness Centre shall verify and ensure, before accepting the claim papers, that all relevant documents are enclosed as per the prescribed checklist and issue a dated acknowledgement to the claimant in token of receipt of the MRC by CGHS.
ii. The CGHS Wellness Centre shall forward the MRC papers online to the Office of Zonal AD/JD, CGHS for further processing for reimbursement of claims. The physical papers shall be sent to the office of the AD/JD within one / two days of receipt of claim papers.
iii. If there are still any deficiencies / gaps found in MRC documents/papers, the Office of AD/JD, shall retain the papers and communicate the list of deficiencies / observations, preferably online, to the CMO-I/C for removing the shortcomings. The MRC may also be returned in original to the CMO- I/C, if it is absolutely necessary for doing the needful to remove the deficiencies inconsultation wïth the beneficiary.
iv. The CMO-I/C shall contact the beneficiary concerned and inform him about the shortcomings in the MRC papers and request him to submit the requisite information / documents. The CMO I/C shall not return the MRC in original unless it is rejected in total.
v. The MRCs should be scrutinized and processed by the Office of AD/JD as far as possible through computerized software as per the extant policy and instructions issued from time to time about the CGHS rates and admissibility of claims under CGHS.
vi. The amount found admissible as per the CGHS guidelines may be passed for payment and forwarded online / manually to the PAO for making payment. The original documents should also be forwarded simultaneously to the PAO for making payment of the admissible amount to the claimant.
vii. When a bill is sent to the PAO, the details pertaining to the claimant will be entered through computer and the claimant shall be informed of the same along with bill number, amount admissible and details of disallowances clearly indicating the specific reasons / grounds for deductions.
viii. The Office of AD/ID of the zone / city shall submit a weekly report in Form —‘MRC-I’ and Monthly Return in Form — ‘MRC — II’ indicating the details of disposal of MRC cases, to the Office of AD(HQ), CGHS for Delhi & NCR and to the Office of Additional DDG (HQ), CGHS for other than Delhi and NCR CGHS cities.
ix. A separate analytical statement shall be attached with the Monthly Return in Form-’MRC- II’ giving therein, the details of the MRCs pending for 2 months and above, clearly indicating the reasons there for and steps taken to dispose of such cases.
x. The Office of AD (HQ), CGHS, New Delhi and Office of Addi. DDG (HQ), CGHS shall compile the Monthly returns received from the respective zones andc ities and submit a consolidated Monthly Return on MRC cases (Zone-wise/City wise) to the Director, CGHS for monitoring of MRC cases on a monthly basis. A copy of this Monthly Return shall also be endorsed by AD (HQ), CGHS and Addi. DDG (HQ), CGHS to Additional Secretary and Director General, CGHS for his information.
4. All the CMO — I/C of the CGHS Wellness Centres and the ADs and JDs of the zone /city are herby directed to follow the above procedure religiously in both letter and spirit to ensure speedy and timely disposal of the Medical Reimbursement Claims (MRCs) filed by the pensioner CGHS beneficiaries.

The vision of the Citizen/ Client’s Charter is to create an enabling environment for Media and Entertainment sector, with appropriate policy framework, to help it grow at a sustainable annual growth rate of above 12 per cent and, in the process, take the benefits of the emerging technologies to disseminate information on the Government’s policies, programmes and its achievement, and facilitate value based wholesome entertainment for the people of India.
The Mission of the Charter is: 
·                     To effectively disseminate information on the policies, programmes and achievements of Government while ensuring free flow of information to the public and safeguarding freedom of the press and media in general. 
·                     To promote, facilitate and develop the Broadcasting Industry in India and strengthen the Public Service Broadcaster. 
·                     To promote and develop good and value based content for healthy entertainment of people of all ages and create a policy framework for achieving this. 
·                     Universal Digitalization for broadcasting by 2017. 
·                     Expansion of FM Radio network to all cities with a population of one lakh and above by 2014. 
·                     To restore, digitalize, preserve and enhance public access to the archival wealth of films, video and audio resources. 
·                     Digital conversion of Indian Films by 2017.

·                     Setting up teleports by TV Channels for uplinking/ downlinking. 
·                     Issue of permission for Uplinking/ Downlinking of TV Channels uplinked from India. 
·                     Issue of Permission for Down linking of TV Channels uplinked from Abroad. 
·                     Setting up of Community Radio Stations(CRS) by Non-Governmental Organisations(NGO), Educational Institutes and Krishi Vigyan Kendras /Institutes. 
·                     Issue of approval letter for the publication of Indian editions of foreign magazines/ journal/ periodical /New Magazine by an entity having foreign investment in the category of Speciality/ Technical/ Scientific. 
·                     Issue of approval letter for the publication of Indian editions of foreign magazines dealing with news and current affairs/ newspapers by an entity having foreign investment/ facsimile edition of foreign newspaper by an entity having/not having foreign investment. 
·                     To facilitate and encourage the Media Units falling under the administrative control of Ministry to discharge their functions as per their individual Citizens’ Charter and to issue instructions thereof. 
·                     Issue of permission letter to the foreign Producers for shooting of feature films for TV/Cinema and reality shows/commercial TV serials. 
The Charter also highlights the Evaluation Criteria, Performance and Service Standards for each of the services identified.
